Sec. 5.155  Operator requirements.

    (a) The licensee shall ensure that all transmitter adjustments which 
affect the proper operation of a station shall be made by a person 
qualified to perform such adjustments.
    (b) The licensee shall be responsible for ensuring that the person 
operating the transmitter is qualified to operate said station.
    (c) When transmitting radiotelegraphy by any type of Morse Code, the 
operator shall have proved his ability to transmit by hand and receive 
by ear texts in Morse Code signals.
    (d) The provisions of this section shall not be construed to change 
or diminish in any respect the responsibility of station licensees to 
have and to maintain control over the stations licensed to them, or for 
proper functioning and operation of those stations in accordance with 
the terms of the licenses of those stations.
