- FCC Rcd 1411 (1994). The number of U.S. households with telephones is about 102 million currently, and was about 94 million at the time CALEA was enacted. See Telephone Subscribership in the United States, released by the FCC's Common Carrier Bureau (now Wireline Competition Bureau) on February 7, 2002. Table 1 shows that the number of households with telephones was 101.7 million as of July 2001, 100.2 million as of November 2000, and 93.7 million as of November 1994. Appendix C, Table 1 of our Sixth Annual CMRS Competition Report, FCC 01-192, released July 17, 2001, shows that there were 109.5 million wireless subscribers as of December 2000 and 24.1 million wireless subscribers as of December 1994. Thus, there are currently

See 47 C.F.R. § 21.910 which provides that the notice shall be in writing and shall include the name and address of the carrier, the date of the event, the area(s) affected and the channels that are affected by the event. Moreover, as we observed in the LMDS 2d R&O, requiring submission of ownership information that may not be immediately necessary to assess the qualifications of a licensee (i.e., one who currently operates as a non-common carrier) is an efficient and reasonable measure to facilitate the flexibility accorded licensees to change status with a minimum of regulatory interference. - Ownership Restrictions Background. Foreign ownership and citizenship requirements for 37/42 GHz band licensees are set out in Sections 310(a) and 310(b) of the Communications Act, which restrict the issuance of licenses to certain applicants. Section 310(a) prohibits any foreign government or representative from holding a station license. Section 310(b) prohibits certain defined foreign ownership interests in common carrier licenses. Section 101.7(a) of the Commission's rules implements Section 310 of the Act and prohibits the granting of any license to a foreign government or its representative. Section 101.7(b) prohibits the grant of a common carrier license to an applicant who fails any of the four citizenship requirements listed therein. Discussion. We propose to apply Section 101.7 of our rules to the 37/42

Section 310(a) prohibits any foreign government or representative from holding a station license. Section 310(b) prohibits certain defined foreign ownership interests in common carrier licenses. In the NPRM, we concluded that Section 101.7 of the Commission's Rules, which implements Section 310 of the Act, should be applied to the 24 GHz band. Section 101.7(a) prohibits the granting of any license to be held by a foreign government or its representative. Section 310(a) prohibits any foreign government or representative from holding a station license. Section 310(b) prohibits certain defined foreign ownership interests in common carrier licenses. - DBS signal carriage.'' What public interest benefits, if any, would accrue if incumbent cable operators were permitted to acquire or invest in MVDDS licenses? Foreign Ownership Restrictions Certain foreign ownership and citizenship requirements are imposed in Sections 310(a) and 310(b) of the Communications Act that restrict the issuance of licenses to certain applicants. The statutory provisions are implemented in Section 101.7 of our Rules. Specifically, Section 101.7(a) prohibits the grant of any license to a foreign government or its representative. Section 101.7(b) of our Rules prohibits the grant of any common carrier license to individuals who do not meet the citizenship requirements listed in the rule. We propose that MVDDS licensees be subject to Section 101.7 of our Rules, which closely

- We, therefore, tentatively conclude that it is unnecessary to impose eligibility restrictions on incumbent cable operators 3. Foreign Ownership Restrictions 23. Certain foreign ownership and citizenship requirements are imposed in Sections 310(a) and 310(b) of the Communications Act, as modified by the 1996 Act, that restrict the issuance of licenses to certain applicants. The statutory provisions are implemented in Section 101.7 of the Commission's Rules and reflect the restrictions as they must be imposed on 24 GHz license applicants. Specifically, Section 101.7(a) prohibits the granting of any license to be held by a foreign government or its representative. Section 101.7(b) prohibits the granting of any common carrier license to be held by individuals who fail any of the four citizenship requirements

- licensees are set forth in Sections 310(a) and 310(b) of the Communications Act, as modified by the 1996 Act, which restricts the issuance of licenses to certain applicants. Section 101.7(b) prohibits the grant of a common carrier license to an applicant who fails any of the four citizenship requirements listed therein.
