Datacom requested use of 10 MHz bandwidth in the previously authorized common carrier point-to-point microwave frequency bands 2110-2130/2160-2180 MHz and use of the private operational fixed point-to-point microwave frequency band 1850-1990 MHz for transmission of common carrier message traffic. Datacom asserted that it met the standards for obtaining a waiver in accordance with Section 101.23 of the Commission's Rules. With regard to the 2110-2130/2160-2180 MHz bands, Datacom stated that its current point-to-point facilities in the Gulf were inadequate because they were limited by regulation to a bandwidth of 3.5 MHz and it required at least 10 MHz of bandwidth to satisfy the needs of the Federal Aviation Administration (FAA). - requests in their long-form applications, and other winning bidders also filed requests for waiver of the eligibility restriction at that time. In 25 addition, CTC, Craw-Kan, and Northwest filed waiver requests as minor modifications to their long- form applications. Some petitioners argued that they met the waiver criteria established under 26 Federal Communications Commission DA 98-1920 See 47 CFR §§ 101.23 and 101.1003(a)(2). With regard to the first issue, these petitioners made similar arguments in their underlying waiver requests, which were not addressed because there is no de minimis exception to the rule, and, as stated above, they had not otherwise made the required showing under either prong of Section 101.23. With regard to the second argument, after extensive analysis, the Commission concluded that ``all incumbent LECs and cable operators would have incentives to attempt to foreclose competitive entry in their respective markets.'' In criticizing this conclusion, Petitioners challenge the applicability of the rule to rural LECs, but fail to demonstrate either unique facts about their individual circumstances (beyond claiming that
