In that instance, awaiting public notice before grant would undercut the Commission's objective of establishing an efficient and rapid electronic licensing system. C. Common Carrier Traffic Requirements . Based on comments responding to the Part 101 Notice, the Commission revised former Section 21.119 (now Section 101.133) of the Rules, removing the restriction that prohibited the use of common carrier transmitters to carry non-common carrier communications, except in the MDS. The Commission removed the restriction to promote economic efficiencies by obviating the need for a common carrier wishing to provide non-common carrier service to construct separate facilities. - Part 101 R&O that it would waive the filing fee associated with the wireless application to change the regulatory status, but did not include this clarification in the final rules. The Commission proposed in the NPRM in this proceeding to codify this clarification in the Commission's rules. We received no comments or oppositions to this proposal. Therefore, we modify Section 101.133 of the Commission's rules to codify this clarification. Private licensees who wish to become common carrier wireless licensees must ensure that they are in compliance with the provisions of the Act and Commission rules, which includes making all appropriate applications and filings with the Commission and receiving necessary Commission approval. For example, as the Commission stated in the Part 101

- Under this scenario, licensees will elect the status of the services 154 they wish to offer and be governed by the rules applicable to their status. Although no commenters addressed this issue, we believe our approach will promote economic efficiencies by reducing construction and operating costs associated with having to provide separate facilities. This result also is consistent with Section 101.133(a) of our Rules.155 The precise contours of incumbent service are currently unclear. While licenses have been issued, licensees are in various 156 stages of constructing their systems. See 47 C.F.R. § 101.105. 157 See MDS Report and Order, 10 FCC Rcd at 9612-13 (1995). 158 37 E. Site availability requirements were necessary when random selection was used to guard against speculative applicants who sought licenses without performing necessary 1s engineering and site planning. With the use of competitive bidding mandated for these bands, it is no longer necessary to require prior site availability for these bands. Limitations on use of transmitters ($ 101.133) should be eliminated; restrictions on the use of private microwave transmitters are no longer necessary. Restrictions on the shared use of radio stations (5 101.135) should be eliminated; specifically, the requirement to maintain an up-to-date list of system sharers of facilities and their basis for eligibility is unnecessary. c-5
