Inmarsat Hawaii Inc. filed a Letter of Intent seeking access to U.S. market using a planned Ka-band geostationary-satellite orbit space station, INMARSAT-KA97W, which Inmarsat states will operate under the authority of the United Kingdom at the 97.11° W.L. orbital location. Inmarsat requests market access to the United States to provide fixed-satellite service using the 18.3-19.3 GHz and 19.7-20.2 GHz (space-to-Earth) and the 28.1-29.1 GHz and 29.5-30.0 GHz (Earth-to-space) frequency bands. Inmarsat states that operations in the 28.1-28.35 GHz and 28.6-29.1 GHz bands will be on a secondary basis. Inmarsat seeks a waiver of Section 2.106, Footnote NG165,
