- For instance, certain concerns in reality relate to section 90.733(d), which, as amended in 1997, already permits all licensees in the 220 MHz band to combine channels to form channels wider than 5 kHz, as Access 220 proposes to do. A second concern, regarding the 1 MHz offset between transmit and receive frequencies, is governed by rules, sections 90.715 and 90.723, that have been in place since the 220 MHz service was created. Again, nothing in Access 220's request for waiver raises unique harmful interference issues, and Access 220 seeks no waiver of any technical requirements. Accordingly, such concerns provide no impediment to grant of the requested waiver. In addition, contrary to the concern raised by one commenter, the Commission in

As a result, Morgan County seeks 150 watts ERP for both its base and mobile stations. In support of its request, Morgan County provides a showing that it meets the 120 kilometer co-channel separation requirement of Section 90.723(k) of our Rules, 47 C.F.R. § 90.723(k). It also notes that it provides the requisite 10 dB contour protection to the nearest co-channel licensee, which, according to Morgan County, is located 127.6 kilometers away. In further support of the waiver request, Morgan County notes that it previously received similar relief of applicable power limitations to its Station WPTG353, Largent, West

As a result, Morgan County seeks authority to operate with 150 watts ERP for both its base and mobile stations. In support of its request, Morgan County provides a showing that it meets the co-channel distance separation and contour protection requirements of Section 90.723(k) of the Commission's Rules with respect to the nearest co-channel licensee, even with the increased power. Morgan County notes that it has been granted similar relief of applicable power limitations for its operations in the 150 MHz band. - Mobile Branch (Branch) of the Licensing Division of the Wireless Telecommunications Bureau (Bureau) found that the request was an untimely request for modification. The Branch further found that if the correct coordinates were used, the application could not be granted because the Mount Allison site was less than 120 kilometers from ComTech's co-channel station, the minimum distance specified in section 90.723(f) of the Commission's rules. Therefore, the Branch denied CCI's request. In response, CCI submitted a second request for a coordinate change and included a Carey engineering analysis to demonstrate that it provided adequate interference protection to ComTech's station. The Branch rejected CCI's engineering analysis and again denied CCI's request to transmit from Mount Allison because of its proximity to ComTech's

- an effort to show that its operation from Mount Allison adequately protected Com- Tech's neighboring station (call sign WPCX469) from harmful interference. The Branch again denied CCI's request, this time rejecting CCI's interference analysis as untimely and wrong. Relying on its own technical analysis, the Branch explained that CCI failed to meet the exception for short- spacing contained in section 90.723(f) of the Commission rules2 because ``station WPCX469 does not receive 10dB of protection'' and ``the 28 dBu contour of station WPCX448 overlaps the 38 dBu contour of station WPCX469 by more than 20 kilometers.'' D.A. 32. 2 Section 90.723 provided at the time that ``the separation of co- channel base stations shall be 120 kilometers. Shorter separations will be considered
