Because the 420-450 MHz band is allocated to the Federal Radiolocation service on a primary basis, and to the Amateur service and certain non-Federal radiolocation systems on a secondary basis, ReconRobotics sought a waiver of the Commission's rules in 2008 to permit Recon Scout devices to operate in this band. Specifically, ReconRobotics sought a waiver of Sections 90.101, 90.207, and 90.209 of the rules, to (1) permit equipment authorization for the Recon Scout and (2) enable public safety customers to obtain licenses for use of the Recon Scout.
