Request for Construction Extension for Three Automated Maritime Telecommunications System Stations ) ) ) ) ) ) ) ORDER Adopted: December 5, 2000 Released: December 6, 2000 By the Chief, Public Safety and Private Wireless Division, Wireless Telecommunications Bureau: Introduction. On October 17, 2000, Paging Systems, Inc. (PSI) requested a waiver of Section 80.49 of the Commission's Rules, 47 C.F.R. § 80.49, in order to extend the construction deadline for three Automated Maritime Telecommunications System (AMTS) stations. For the reasons that follow, we dismiss PSI's request. Background. AMTS stations provide automated, integrated, interconnected ship-to-shore communications similar to a cellular phone system for tugs, barges, and other maritime vessels. Pursuant to Section 80.49(a)(2) of the

- below, we deny the Petition. Background. AMTS stations provide automated, integrated, interconnected ship-to-shore communications similar to a cellular phone system for tugs, barges, and other maritime vessels. On February 10, 2000, PSI was granted licenses for AMTS stations in Ocean City, Maryland (Station WHV949), Fort Pierce, Florida (Station WRV468), and Myrtle Beach, South Carolina (Station WXY924). At that time, Section 80.49(a)(2) of the Commission's Rules required that AMTS stations be placed in operation within eight months of the license grant. Based upon the record before us, it appears that PSI did not construct these stations on or before October 10, 2000, and, as a result, these authorizations automatically cancelled pursuant to Section 1.955(a)(2) of the Commission's Rules on October 11, 2000.

Maritel also asserts, however, that its ability to meet its five-year substantial service benchmark under Section 80.49 of the Rules, 47 C.F.R. § 80.49, will be hampered if it must wait for the culmination of the rulemaking proceeding without obtaining the requested waiver relief in the interim. In the context of AMTS, the term ``integrated'' conveys the requirement that the base stations in an AMTS system must be connected, thereby ensuring seamless communication throughout the system for a vessel traveling along a served waterway. Construction requirement. Next, you ask several questions regarding Section 80.49(a)(3) of the Commission's Rules, which requires that AMTS public coast station licensees place the authorized stations or frequencies in operation within two years from the date of grant. First, you ask whether the rule requires an AMTS licensee to place all of its authorized spectrum into operation in order to satisfy the construction requirement. The rule does not require this.

We also note that the applicants have not here requested a waiver of the construction requirement in Section 80.49(a) of the Commission's Rules, 47 C.F.R. § 80.49(a). Consequently, our grant of the applications proposing to partition and disaggregate spectrum in VPCSAs 9, 10, 12, 15, and 19-22 shall be conditioned on the outcome of the pending construction extension requests relating to those licenses. - that these circumstances can fairly be said to have been solely under MariTEL's control in the same way that the relevant matters were under the control of the licensees that were denied construction waivers in the cases cited by the Coast Guard. In sum, we believe that it was appropriate under the circumstances presented for the Division to waive Section 80.49(a)(1) of the Commission's Rules and extend the five-year construction deadline with respect to MariTEL's maritime VPCSA licenses for an additional two years, until May 19, 2006. The increasing availability in recent years of alternative wireless communications services to meet this segment of the maritime community's demand for voice service at ever lower costs is a unique or unusual circumstance affecting

- for land mobile communications. According to MariTEL, if maritime and land mobile users do not share the same channels, the requirement to ensure priority for maritime communications is satisfied. MariTEL requests that the Commission expressly endorse this approach by clarifying that as long as a licensee provides maritime service over a sufficient area to satisfy the coverage requirement in Section 80.49 of the Rules, the licensee is free to provide land mobile radio service on its other channels and in other areas. Havens also supports this approach. Mobex concurs that the most practical means of ensuring priority for maritime communications is for licensees to use some of their channels for maritime communications exclusively and other channels for land mobile communications exclusively.
