- that the assigned frequency band for this 2.8 kHz allocation is not in accordance with the definition of ``assigned frequency band'' in Section 2.1, which is the ``definitive...definition and shall prevail throughout the Commission's Rules.'' Therefore, we correct this assigned frequency band by reflecting the frequency tolerance for Alaska fixed stations - 20 Hz - which is listed in Section 80.209(a). As background, we note that Section 80.387 states that: 1) the carrier frequency 7368.5 kHz is assignable for point-to-point simplex radiotelephone communications between private fixed stations in Alaska; 2) the peak envelope power must not exceed 1 kW for radiotelephony; and 3) teleprinter use is authorized. On May 18, 2010, the Commission's Universal Licensing System (ULS) listed 17 call signs

- 80.89(f): ``Stations must not: Transmit on frequencies or frequency bands not authorized on the current station license.'' A transmitter operating on the frequency 17211.4 kHz was operating at the Rio Vista, California location. This transmitter is not authorized at that location. Globe Wireless is licensed for 17211.4 kHz under the call sign KFS for Palo Alto, California. 47 C.F.R. § 80.209(a)(3)(i): ``The frequency tolerance requirements applicable to transmitters in the maritime services are shown in the following table. Tolerances are given as parts in 106 unless shown in Hz.'' The KPH transmitter authorized for 19730.5 kHz was operating on 19730.558 kHz. This is 58 Hz from the authorized frequency which exceeds the tolerances listed in the following table. Frequency bands and

- has proposed numerous deletions to the authorized emission classes. Based on the current record, we decline to delete the radiotelegraphy emission classes, for the reasons discussed above. Instead, in order to build a fuller record upon which to base a decision, we seek comment on the issue in the Further Notice of Proposed Rule Making portion of this document. § 80.209. Section 80.209 of our Rules provides the frequency tolerance requirements applicable to transmitters. We agree with the USCG that the frequency tolerances of 1000, 3000, and 5000, which were only applicable to transmitters approved before November 30, 1977 and are no longer permitted, and footnotes 3 and 5, which set forth frequency tolerances applicable only until February 1, 1999, should

- testing requirement is beyond the scope of this proceeding. We therefore retain the requirement for weekly testing of the equipment. Other Matters We take this opportunity to remove obsolete provisions and correct typographical errors in Part 80. These are non-controversial rule amendments that the Commission may adopt without notice and comment. Specifically, we remove obsolete provisions from Sections 80.205, 80.207, 80.209, and 80.375(d), remove obsolete references to Class A and Class B EPIRBs from Sections 80.15(e), 80.310, and 80.905(a)(3)(iii)(B), update the cross-reference in the Section 80.5 definition of ``navigable waters,'' conform the commercial radio operator license codes referenced in the Part 80 rules to the codes actually used for such licenses in the Commission's Universal Licensing System (ULS) database, and correct
