Wethereforerejectargumentsthatweshoulddefmeutilityaccesstoabuildingasinitselfestablishing utilitycontroloverconduitsorrights-of-wayorestablishpresumptionsinthisregard.Weemphasizethat therightofaccessgrantedunderSection224liesonlyagainstutilities,andthatSection224isnot intendedtooverridewhateverauthorityorcontrolMTEownersmayotherwiseretainunderstatelaw.228 Wethereforeconcludethat"consistentwiththepurposesofSection224,utility orcontrolof rights-of-wayandothercoveredfacilitiesexistsonlyiftheutility provideaccesstoa thirdpartyandwouldbeentitledtocompensationfordoingso.AstheRealAccessAlliancepointsout, theformsofaccessarrangementsbetweenutilitiesandbuildingOVlllers,andthe rightsand responsibilitiesofeachparty,canvarygreatlydependingonthemeansbywhichaccess\"I-asorigiJJl2lIy achievedandonstatelaw.229Thus,statelawdetermineswhether,andtheextentto ownershiporcontrolofaright-of-wayexistsinanyfactualsituationwithinthemeaningofSection224. 88.Wenotethatexistingutilityrights-of-wayinMTEs,whethercreatedbyforceoflaw,by writtenagreementbetweentheparties,orbytacitconsent,generallyoriginatedinaneraofmonopoly utilityservice.Thus,thepurposebehindtheserightsofaccess wastoensurethatenduserscouldreceive servicefromthesingleentitycapableofproviding,orlegallyauthorizedtoprovide,suchservice.The partiesthatestablishedthetermsof theserightsofaccesswouldrarely,ifever,haveconsideredtheeffect theiractionsmighthaveonhypotheticalfuturecompetition.Section224addressestheabilityofutilities toactanticompetifivelywithrespecttotelecommunicationscompetitorsasaresult these developments.Ourconcernsaboutanticompetitiveexclusion buildingownersareaddressed elsewhereinthisitem. 89.Thisapproachavoidsanyconstitutionalconcernsthatmayariseundert.neFifthAmendment. BecauseweinterpretSection224toapplyonlyagainstutilities,thereisnotakingfrompremisesowners. TheonlytakingunderSection224isfromntilities,whoaredeprivedofthepowertoexcludeothers fromconduitsorrights-of-waytotheextentoftheirownershiporcontrol.Thistaking,however,is compensatedunderstatuteandourrules,andthusisfullyconsistentwithconstitutionalrequirements.DO 226 Id.. 227 ld. 228 Wenote,however,thatnothinginSection224preventsastatefromextendingtheprinciplesofSection224under statelawtoentitiesotherthanthoseconsideredtobe'"utilities,"asthaftermisdefinedinthefederalstatute.For example,Massachusettsrecentlypromnlgatedbuildingaccessregulationswhichincludeapremisesownerwithinthe definitionof'"utility." MassachusettsNondiscriminatoryAccessOrder. 229 RealAccessAllianceCommentsat53-55.Wefurthernotethattheparties'respectiverightsandresponsibilities maytypicallybedifferentoverrights-of-waylocatedoutsidebuildingsthaninsidebuildings.Forexample,rigbts-of- wayoverlandaretypicallyusedtoprovideservicetothegeneralpublic,whereasrigbts-of--wcableinsidewiring.Section76.804(a)ofourrulessetsforththeproceduresfordispositionof"homerun wiring"ownedbyamultichannelvideoprogrammingdistributor(MVPD)inamultipledwellingunit (MDU) whentheMVPD"doesnot...havealegallyenforceablerighttoremainonthepremisesagainst thewishesoftheMDUowner.,,231Asexplainedabove,Section224grantsarightofaccessonlytothe extentautilityownsorcontrolspoles,ducts,conduits,orrights-of-way.Itdoesnotgrantalegally enforceablerighttoremainonthepremisesagainstthewishesoftheMDUowner.Therefore,itdoesnot interferewiththedispositionofcablehomerunwiringunderourrules. c. - Ameritech states that it is unclear if access is required within 24 hours before service termination or within 24 hours after service termination. We agree with Ameritech that the requirement that an "incumbent shall make the home wiring accessible to the alternative provider within 24 hours of actual service termination" is ambiguous. Accordingly, we will amend the language of Section 76.804(b)(3) to provide that where the MDU owner or the alternate provider chooses to purchase the home run wiring, the incumbent must provide access during the 24-hour period prior to actual service termination to enable the new provider to avoid a break in service. We believe that this change makes the rule easier to understand and provides some assurance to MDU
