- Regulatory Review -- Streamlining of Cable Television Services Part 76 Public File and Notice Requirements, Report and Order, CS Docket 98-132 (FCC 99-12, 14 FCC Rcd 4653 (1999)) was published in the Federal Register on September 5, 2000. The rules revised and streamlined the public file and notice requirements, and reduced the regulatory burden faced by cable operators. Sections 76.1622, 76.1713, and 76.1800 contained information collection requirements that required approval from the Office of Management and Budget (``OMB'') before they could become effective. OMB approved the information collection requirements on June 7, 2001 (see OMB No. 3060-0981). Accordingly, Sections 76.1622, 76.1713, and 76.1800 will become effective upon publication of this notice in the Federal Register. Media Contact: Michelle Russo 202-418-7200 Cable

- by subscribers. Further, at this time, we find it unnecessary to impose special technical requirements to ensure an equivalent level of good quality service as provided for by Section 76.605(b). We note, however, that RCN must continue to meet the ultimate obligation to provide a good quality signal to subscribers and to comply with the complaint resolution provisions in Section 76.1713. Therefore, we grant RCN relief from Section 76.601 of the Commission's rules as it pertains to Sections 76.605(a)(1) through Section 76.605(a)(11) for the systems at issue until such time when the Commission may revise the rules to adequately address systems utilizing all-digital transmission. - The Media Bureau explained that requiring RCN to perform proof-of-performance tests on its all-digital systems and to maintain the results for inspection would impose ``an unnecessary expense and provide[] no benefit to the public.'' The Media Bureau's Order provided, however, that RCN must provide a good quality signal to subscribers; RCN must comply with the complaint resolution provisions in Section 76.1713; and the relief granted will continue until such time as the Commission revises its rules to address systems utilizing all-digital transmission. On November 17, 2009, Montgomery County, the LFA for the portion of RCN's Washington, DC system located within the county, filed a Petition for Reconsideration of the Media Bureau's Order.
