Therefore, we propose to amend the Commission's rules in Part 74 to authorize motion picture and TV producers as well as TV BAS license holders to use VHF-TV and UHF-TV spectrum for WAVDs under conditions as set forth below. We propose to add the rules for these devices in a new Section 74.870 in Part 74, Subpart H, Low Power Auxiliary Stations. WAVDs would be subject to complying with all rules in Subpart H, except where such requirements differ from those described below. i. NCPD's Petition states that public safety operations also use the band 500-506 MHz (UHF-TV channel 19) under waiver in the NY/NJ area, and requests that we amend Section 74.870(c)(4) to exclude WAVD operation in this band as was similarly done for UHF-TV channel 16. NCPD states that the exclusion is needed to protect the over 100 existing public safety land mobile base stations operating on UHF-TV channel 19. We remind licensees of Wireless Assist Video Devices (WAVD) operating under Part 74, Subpart H - Low Power Auxiliary devices, that WAVD operation is on a secondary, non-interference basis to TV broadcast and land mobile operations, on TV channels 8-12, 14-36 and 38-51. See Sections 74.803 and 74.870. Thus, WAVD operation on TV Channel 17 (488-494) MHz in the eastern part of Suffolk County should be avoided, to avert interference to public safety land mobile operations on adjacent TV Channel 16. WAVD operation on TV Channels 15 and 16 in this area are already prohibited by Section 74.780. In the 1995 Waiver Order, the Commission stated that it
