We will waive the following rules as inapplicable to the services provided under this pilot project: 47 C.F.R. § § 74.731(g)(permissible service), 74.732(g)(booster eligibility), 74.736(a)(emissions), 74.750(a)(FCC transmitter certification), 74.751(a)(modification of transmission systems), 74.761(frequency tolerance), and 74.763(c)(time of operation). Paragraph 19 of the Implementation Order, regarding facilities changes, will continue to apply. Applications to change channel or transmitter site location(s) must be filed in the normal manner on FCC Form 346, seeking a modified construction permit for the underlying analog facilities of the licensed LPTV station or

- on special circumstances. In this regard, we seek comment on what technical standards and interference criteria should apply to transmitted material if and when a free off-air video program service is not required. Analog LPTV and TV translator stations are required to operate with a transmitter that is either ``certificated'' by the Commission for compliance with the requirements of Section 74.750(c) of our rules, or alternatively, qualifies for use under the TV broadcast rules in Part 73. Transmitters that qualify for use under the TV broadcast rules must be evaluated for compliance with the technical rules for that equipment under the ``verification'' procedure. The Commission's ``certification'' and ``verification'' procedures specify requirements for authorization of radiofrequency equipment by the Commission and manufacturer

- and TV translator station operations on channels 22-24, 36, 38, and 65-69. This filter requirement and the associated emission limits are for the protection of GPS operations only from possible harmonic emissions from digital LPTV and TV translator station operations and does not apply to other possible sources of emissions in the GPS bands. Other Transmission System Facilities Issues Section 74.750 of our rules requires that analog transmitters operated at LPTV and TV translator stations must either be ``certificated for licensing'' by the Commission or qualify for use under the TV broadcast rules in Part 73, which provide a verification procedure. The rule provides specific technical requirements that must be met before the Commission will certify LPTV and TV translator transmitters.
