- Agent, Miami Office, South Central Region, Enforcement Bureau: INTRODUCTION In this Notice of Apparent Liability for Forfeiture (``NAL''), we find that Caribevision Station Group, L.L.C. (``Caribevision''), licensee of station WFUN-LD, in Miami, FL, apparently willfully and repeatedly violated Section 11.35(a) of the Commission's Rules (``Rules'') by failing to install operational Emergency Alert Systems (``EAS'') equipment and apparently willfully violated Section 74.735(b)(2) of the Rules by exceeding the maximum effective radiated power (``ERP'') for a digital low power television (``LPTV'') station. We conclude, pursuant to Section 503(b) of the Communications Act of 1934, as amended (``Act''), that Caribevision is apparently liable for a forfeiture in the amount of twelve thousand dollars ($12,000). The design utilized an alternate transmitter and three television booster stations, operating at increased power, spaced throughout the island. In 1992, the Commission granted Siete Grande waivers of Sections 73.1675(a) and 74.735(d) of the Rules in order to permit operation of the multi-station facility on a regular basis. Siete Grande, 7 FCC Rcd 5299 (1992). Siete Grande now seeks a special ``unitary'' license which would cover the auxiliary and booster sites, in lieu of each site having a separate license. This new license would treat the multi-site transmission facility as a collective

Thus, we ask if the presumption of displacement should be extended to LPTV and TV translator stations authorized on these channels, giving these operators an immediate opportunity to seek replacement channels while such channels might still available. We recognize this could lead to additional competition for Federal Communications Commission FCC 99-257 84 In the DTV proceeding, section 74.735 of the LPTV rules was amended to replace transmitter power output limits with limits for effective radiated power. The limits for analog LPTV and TV translator stations are 3 kW and 150 kW for VHF and UHF channels, respectively. For digital operations, the limits are 300 watts for VHF and 15 kW for UHF stations. 85 CBA points to the

- Office, South Central Region, Enforcement Bureau: I. INTRODUCTION 1. In this Notice of Apparent Liability for Forfeiture ("NAL"), we find that Caribevision Station Group, L.L.C. ("Caribevision"), licensee of station WFUN-LD, in Miami, FL, apparently willfully and repeatedly violated Section 11.35(a) of the Commission's Rules ("Rules") by failing to install operational Emergency Alert Systems ("EAS") equipment and apparently willfully violated Section 74.735(b)(2) of the Rules by exceeding the maximum effective radiated power ("ERP") for a digital low power television ("LPTV") station. We conclude, pursuant to Section 503(b) of the Communications Act of 1934, as amended ("Act"), that Caribevision is apparently liable for a forfeiture in the amount of twelve thousand dollars ($12,000). II. BACKGROUND 2. On December 18, 2009, the Enforcement Bureau's
