Additionally,Chambersallegesthatourpolicy"runscontraryto thetheoryofpreferenceofaprimarysignaltoacommunityovera secondarysignal."ItcitiesHarriscopeBroadcastingCorporation,38 FCC2d328(1972),forthepropositionthatitiswithintheCommission's discretiontoreviewtheimpactofatranslator'soperationontheoperation ofafullservicestation,andthusthereisnoassuranceinthepresentcase thattheprotectioninSection74.1232(d)(1)willultimatelybeaccorded StationKGBR(FM).'°However,reviewofapetitionforterminationisnot permissive.Rather, HarriscopeBroadcastingandPeninsulaCommuni- cationsbothmakeclearthatuponreviewofchangedcircumstances, which,hadtheyexistedatthetimethetranslatorapplicationwasfiled wouldhaveprohibitedagrant,theCommissionmaydeterminethat terminationofthetranslatorisnotinthepublicinterest.InHarriscope BroadcastingweconcludedthattheviabilityofthenewlocalUHF-TV stationcouldbeensuredbyprotectingitsprogramsagainstduplicationby theTVtranslatorsservingthesamecommunity,andthatthepublic interestintheavailabilityofawidechoiceofprogramswarranted maintainingthetranslators'authorizations.Thus,wheretranslatorser- viceinacommunitypreceedstheinitiationofafirstlocalFMservice, thereisanopportunitytoassesswhetherthereisadetrimentalimpactby thetranslatorontheviabilityofthenewcomerFMfacility,orwhether thesestationscancompetitivelyco-exist,makingavailabletothepublica widerdiversityofvoices. 11. Itisclearthatthecircumstancesofthiscasedonotactivatethe protectionofSection74.1232(d)(1).NotonlywasStationKGBR(FM)not operationalatthetimethesetranslatorapplicationswerefiled,but contrarytoChambers'representationinitsapplicationsforreview,the constructionpermitforthatstationhadnotevenbeengranted.Station KGBR(FM)hasbeenauthorizedsinceJanuary,1981,andtothisdate, remainsunbuiltandnon-operational.Thepublicinterestisbestservedby permittingFMtranslatorservicebeyondtheseprimarystations'1mV/m contoursbythestationlicenseespendingtheeventualcommencementof operationsbyStationKGBR(FM). 12. Inthisregard,andinconclusion,weareunpersuadedbyCham- bers'argumentthatourpolicyforapplyingtheproscriptioninSection 74.1232(d)(1)ofourRuleseschewsourpoliciesagainstregionalconcentra- tionofcontrol.Wenotefirstthatwerecentlyrepealedtheregional concentrationofcontrolprovisionsofthemultipleownershiprules.See '°HarriscopeBroadcastinginvolvedtheapplicationofSection74.732(f)oftheRules, whichistheterminationprovisionforTVtranslatorstations.Section74.1232(h)parallels Section74.732(f). 101F.C.C.2d 576 FederalCommunicationsCommissionReports MultipleOwnership(RegionalConcentrationofControlProvision),96 FCC2d578,55RR2d1389(1984).Secondly,Section74.1232(b)specifically providesthatFMtranslatorsdonotcountforpurposesofourmultiple ownershiprules.Wereiteratethatwebelievethatourpolicybestserves thepublicinterestinauralFMbroadcastservice,ourpolicybestserves thepublicinterestinauralFMbroadcastservice,andconcludethat retroactiveapplicationofSection74.1232(d)(1)viaSection74.1232(h), wherethereisevidenceofadetrimentalimpactbythetranslatoronthe newlocalFMfacility,sufficientlyguardsagainstanythreatofregional concentrationofcontroloreconomiccompetitioninjurioustothepublic interest. 13.Accordingly,ITISORDERED,thattheaforementionedApplications forReviewbyChambersBroadcastingAREHEREBYDENIED.
