- its operations would be incompatible with those of other users in the relevant frequency band. Furthermore, it should be noted that the equipment authorization for Part 90 of the proposed equipment provides for D1 emissions.'' Chevron notes, however, that the engineering test results that were submitted in support of the equipment certification application for the MDS LEDR equipment under Section 74.462(c), would satisfy an "extrapolated" 50 kHz channel equivalent emissions mask as defined in Section 90.210(c), for any emissions outside of the 50 kHz channel. Chevron further states: ``It should be noted that because digital modulation has a "square" spectral dispersion, no digital modulation could meet the emissions mask defined in Section 90.210(c) for analog modulation and still provide the spectral

- of Violation (``Notice'') issued pursuant to Section 1.89 of the Commission's Rules to Wilfredo G. Blanco Pi, licensee of radio station WPNM762 in Aguada, Puerto Rico. On August 5, 2005, an agent of the Commission's San Juan Office monitored radio station WPNM762 located in Aguada, Puerto Rico, specifically in the Atalaya Ward, and observed the following violation: 47 C.F.R. § 74.462(d): ``In the event a station's emissions outside its authorized channel cause harmful interference, the Commission may, at its discretion, require the licensee to take such further steps as may be necessary to eliminate the interference.'' On April 28, 2005, an agent monitored the emissions of WPNM762 and found that the second harmonic of the authorized frequency of 943.850 MHz, 1887.7

- Bureau: This is a Notice of Violation ("Notice") issued pursuant to Section 1.89 of the Commission's Rules, to Citicasters Licenses, L.P. (``Citicasters''), licensee of radio station KC23594. On May 5, 2005, in response to a complaint, agents from the Commission's Portland Resident Agent Office inspected radio station KC23594 located in Portland, Oregon, and observed the following violation(s): 47 C.F.R. § 74.462(d): ``In the event a station's emissions outside its authorized channel cause harmful interference, the Commission may, at its discretion, require the licensee to take such further steps as may be necessary to eliminate the interference.'' KC23594 is licensed to transmit on fundamental frequency 450.700 MHz with a bandwidth of 50 kHz and output power of 15 watts. At the time

- narrow channels may improve adjacent channel performance, but will it harm the quality of the information being transmitted? Additionally, we propose to formally acknowledge the protected status of non-Federal Government stations operating on these frequencies that are used as an integral part of the EAS. These proposals encompass a revision of Section 2.106, footnote US11 and a change in section 74.462 of our rules. We seek comment on these proposals. C. Universal Licensing System and BAS As noted above, the WTB, which is responsible for licensing BAS, has shifted its licensing functions to ULS. ULS is an automated licensing system and integrated database designed to infuse greater efficiency into the licensing process by using a consolidated set of application forms, automating

- if migrating to the narrow channels would degrade the quality of the information being transmitted. Additionally, we proposed to formally acknowledge the protected status of non-Federal Government stations operating on these frequencies that are used as an integral part of the EAS. We sought comment on these proposals as well as proposed amendments to Section 2.106, footnote US11, and Section 74.462 of our rules to implement these proposals. SBE and NTIA were the only parties commenting on this issue. SBE supports our proposals to mandate the conversion of Remote Pickup BAS to 12.5 kilohertz channels on 166.25 MHz and 170.15 MHz by January 1, 2005. SBE also suggests that Remote Pickup BAS base station use of 166.25 MHz and 170.15 MHz

- kHz from Section 90.20(c)(3); the frequencies 1614 kHz, 1628 kHz, 1652 kHz, 1676 kHz, and 1700 kHz from Section 90.35(b)(3); and the band 1605-1705 kHz from Section 90.263. Consistent with our action removing frequencies 1606 kHz, 1622 kHz, and 1646 kHz from Section 74.402(a)(1), we are also eliminating all references to those frequencies from Sections 74.402(a) and 74.402(e)(1) and Section 74.462(b). As proposed in the Notice, mobile TIS stations will continue to be authorized throughout the AM Expanded Band as specified in Part 90 and Federal Government TIS stations operating on 1610 kHz will have primary status. While there are currently no Public Safety or remote pickup licensees operating in the AM Expanded Band, four Industrial/Business Pool and two non-Federal Government
