Itiswellsettledthatanapplicantbearstheinitialburdenofdemonstratingthatthedocument inquestionwasproperlydeliveredtotheCommissionwhentherenorecordofsuchfiling.Ifregular mailservicewasused,theapplicantmustsubmitproofthatthedocumentwasproperlyaddressedto theCommission,hadsufficientpostage,andwasdepositedinthemail.Thatadeliveryserviceother thanregularmailisuseddoesnotmateriallyaffectthetypeofproofthatmustbesubmitted." GLCB'self-servingclaimthattheamendmentwaslostisunsupportedbyanyevidence.'2Inany event,thecoverlettertotheSeptember3,2002amendmentindicatesthatthemissingamendment wasoriginally"sent"inAugustof2001,whichitselfwouldbeanuntimelyfiling.Accordingly,the amendmentsubmittedwiththeSeptember3,2002petitionforreconsiderationwillbedismissed. EvenwerewetoconsiderthemeritsofGLCB'sproposedamendment,wefindthat reconsiderationcannotbegrantedbecausetheamendmentfailstoeliminatetheconflictbetweenthe applications.Specifically,theproposedGLCB100dBuinterferingcontouroverlapsthe60dBu contouroftheSpringArborapplication,inviolationof47CFRSection73.509.'3Seetheattached contourplot.Thisoverlapisnotshownintheintheamendment,whichvastlyunderstatestheextent oftheSpringArborapplication's60dBucontour.Consequently,theamendment,whenconsidered aspartofGLCB'spetitionforreconsideration,istechnicallyunacceptableforfilingandwillbe dismissed.14 Conclusion.Accordingly,GLCB'sSeptember3,2002filing,whenconsideredasapetition forreconsideration,ISDENIED,andwhenconsideredasanuntimelyamendment,1SDISMISSED, bothbecauseitisuntimelyandbecauseitfailstoeliminatetheapplicants'mutualexclusivityand 10PublicNotice,"DeadlineforNCESettlementsandSupplementsExtendedtoJuly19,2001,"16FCCRcd10892 (M.M.Bur.2001)("SettlementExtensionPublicNotice"). 11Hughes-MooreAssociates,Inc.etal.,7FCCRcd1454,1455(1992). 'zItisnoteworthythatGLCBdidnotpurporttofileacopyoftheallegedlymissingamendmentwithitlatestpetitionfor reconsideration.TheSeptember3,2002amendmentisclearlyanewfiling,withsignaturedatesofAugust30and31, 2002,andthecontourplotsincludedwiththeamendmentweredatedAugust26,2002.Thereisnoinformationthat wouldleadustoconcludethatanypartoftheamendmentwascreatedearlierthanAugust26,2002. "GLCBcannotsimultaneouslyusetheproposedtransmittersitewhileavoidingprohibitedcontouroverlapwith applicationBPED-19980713MD,andprovide60dBucoverageof50%ormoreofJackson(asisnowrequiredby47 CFRSection73.515).ToproperlycoverJacksonwithoutprohibitedcontouroverlapwiththeSpringArborapplication (assumingnochangesintheSpringArborproposal),GLCBwouldhavetorelocatethetransmittersitenortheastward(to movetheinterferingcontourfurtheraway)whileincreasingpower(tomaintaincoverageofJackson).Wehavenot conductedananalysistoshowwhetherthisisfeasible. 14Additionally,wenotethat,becausethereisno"technicaldefect"thatGLCBseekstocorrectbyvirtueofthis amendment,theCommissionpolicywhichallowsNCEFMapplicantsoneopportunitytoamendtocorrecttechnical deficienciesdoesnotapplyinthiscase.SeePublicNotice,"CommissionStatesFuturePolicyonIncompleteand PatentlyDefectiveAMandFMConstructionPermitApplications,"56RR2d776,49FedReg.47331(1984), referencedin47C.F.R.§73.4015. fulfillthetermsofthesettlementagreement.TheactiontakenintheAugust12,2002letter,which deniedtheJuly19,2001JointRequestforApprovalofAgreementfiledonbehalfofSpringArbor UniversityCommunicationsandGLCBCommunityBroadcasting,Inc.anddisapprovedthe agreement,remainsintact.Furthermore,becauseGLCBfailedtosubmitthepointsupplement requestedbythestaffintheAugust12,2002letterandrequiredbytheSettlementExtensionPublic Notice,itsapplicationISDISMISSEDpursuanttothetermsofthosedocuments.Allpleadingsfiled againstacceptanceorgrantoftheGLCBapplicationAREDISMISSEDASMOOT.
