- By the Chief, Enforcement Bureau: 1. This Forfeiture Order (``Order'') imposes a forfeiture against WRHC Broadcasting Corp. (``WBC'') in the amount of twenty-two thousand five hundred dollars ($22,500). It also directs WBC to inform us within thirty (30) days whether it is continuing to operate Station WRHC in an unauthorized manner. We conclude that WBC willfully and repeatedly violated sections 73.1615, 73.1620 and 73.1745 of the Commission's rules. The violations include operation of a directional AM station, purportedly in accordance with a construction permit, without first requesting and obtaining authority from the Commission, commencement of program tests prior to staff approval, and operation at variance from licensed facilities. The violations also resulted in interference to another station. BACKGROUND 2. Following receipt

During construction and testing of the modified facilities, Metro Radio sought and received special temporary authority (``STA'') under Section 73.1615 of the Rules to operate with the facilities authorized in the Construction Permit in order to make final transmission system adjustments and take proof of performance measurements. Metro Radio completed construction of the Station's modified facilities, and filed the Application and a request for program test authority (``PTA'') on March 2, 2006. Both applications indicated that A-O had operated the station after the November 8, 2002, Section 312(g) forfeiture of its license. A-O claimed that such operations were authorized pursuant to Section 73.1615 of the Rules, pertaining to modification of facilities. On July 31, 2003, the staff dismissed both applications along with the associated waiver request, without written decision, and updated its database to reflect those actions. We propose that, except in the case of equipment failure, natural disaster, or other unforeseeable emergency, stations would only be permitted to terminate analog service on the date they elect. In addition, we propose that the timing and advance notice for analog terminations to be adopted in this proceeding will supersede the provisions of Section 73.1615. Stations would be able to rely on the flexibility of Section 73.1615 for brief terminations or reductions of service for technical reasons, as originally contemplated by that section. They would not, however, be permitted to rely on this provision to terminate analog service altogether, even in the days immediately prior to June 12, 2009. A station's analog service termination would

Any station that does not properly file this notification will not be permitted to terminate their analog service prior to June 12, 2009, except in the case of equipment failure, natural disaster, or other unforeseeable emergency.

The permit fully protected the licensed WCOJ(AM) facilities from interference in accordance with Sections 73.187 and 73.37(a) of the Commission's Rules (the ``Rules''). On February 22, 2006, Group A filed a

On August 6, 2003, the staff sent a letter to A-O explaining the basis for its July 31, 2003 actions. The staff stated that the applications

They must install necessary filters, take other precautions and submit evidence that no interference is being caused before they will be permitted to transmit programming on the new facilities. Thus, they will not be allowed to commence automatic program tests pursuant to Section 73.1620 or to commence operation with the modified facilities pursuant to Section 73.1615. The responsibility of a new or modified TV channel 14 or 69 station to correct interference to an existing land mobile facility [has been] incorporated into the Commission's rules [as 47 C.F.R.
