Since Weston, West Virginia, is located within the protected areas of the NRAO's "Quiet Zone" at Green Bank, West Virginia, the licensee of station WDTV-DT will be required to comply with the notification requirement of Section 73.1030 of the Commission's Rules. Withers submits an engineering study noting that Section 73.525(c) of the FCC rules permits new NCE-FM stations to cause predicted interference up to 3,000 people within the analog service area for a TV channel 6 operation. The study states, based on the requirements of new NCE-FM stations, that the calculated interference from the proposed channel 6

- Lake Cedar recently received approval by Jefferson County for its modified tower. CARE raises four matters in opposition to Lake Cedar's modified tower. CARE argues that operation of the Stations' analog and DTV facilities from the modified tower would not comply with the following Commission Rules: (1) protection of the radio receiving zone at Table Mountain, Boulder County, Colorado (Section 73.1030(b)); (2) compliance with the radiofrequency radiation exposure limits (Section 1.1310); (3) protection of historic sites (Section 1.1307(a)(4)); and (4) protection of Indian religious sites (Section 1.1307(a)(5)). Commission staff recently concluded that the Lake Cedar modified tower would comply with the Table Mountain protection requirements set forth in Section 73.1030(b) of the Rules. Cox states that in order to provide protection to that monitoring station, Petitioner would be obligated to utilize a directional antenna, which, in turn, would reduce the signal strength in the direction of Waianae below the level required for city-grade coverage. Cir. 1995), is misplaced as the Commission in that case had promulgated a regulation under the National Radio Astronomy Observatory ("NRAO") that it "will consider all aspects of the problem" when addressing an objection on the grounds that granting a license would cause interference to the NRAO, 47 C.F.R. § 73.1030(a). See 62 F.3d at 1444-48. Although Achernar is relevant to the extent it stands for the proposition that the Commission must engage in reasoned decisionmaking and consider the entire record in an adjudicative hearing, it is 22 readily distinguished on a variety of grounds, including that, unlike the fast-track auction regime, there was an "all aspects" regulatory requirement, and at

Low power FM broadcast stations will be required to coordinate with and provide protection to the radio quiet zones at Green, West Virginia and at Boulder, Colorado, as is required for full service FM stations by Section 73.1030. In addition, low power FM applicants in Puerto Rico will need to coordinate with Cornell University regarding the radio coordination zone on that island. This requirement is necessary to ensure that research work at these installations will not be disrupted.
