WCB staff again finds that these rules are not necessary in the public interest for the reasons set forth in the Commission's previous review, and thus recommends that the Commission eliminate these sections in the context of ongoing rulemaking proceedings. The staff also recommends that the following provisions be updated: 47 C.F.R. §§ 54.5, 54.201-207, 54.303(b)(4), 54.5, 54.623, 54.901(b)(2), and references to 47 C.F.R. §§ 54.903(a), 54.903(c), 54.903(d), 54.903(e); and that the following provisions for which funding periods have expired be removed: 47 C.F.R. §§ 54.507(a)(1)-(2), 54.604(a)(2). INTRODUCTION In this order, we grant a request for reversal of a decision by the Universal Service Administrative Company (USAC), denying funding for discounted services under the rural health care universal service support mechanism to Bradford Regional Medical Center (Bradford RMC). In so doing, we waive section 54.623(c)(3) of the Commission's rules, which establishes the filing deadline for all required forms under the rural health care universal service support mechanism. We find that good cause exists to grant the request and remand the application to USAC for action consistent with this order. We direct USAC to complete its review and analysis no later than 60 days from the

- negotiate with vendors, or prepare funding commitment requests. As discussed above, delays for these projects have been due to, among other things, the economic downturn affecting the ability to raise the 15 percent funding match requirement, ongoing negotiations over complex network deployment agreements with vendors, and coordination of projects with potential ARRA funding. We therefore find that waiver of section 54.623(b) is necessary for the sound and efficient administration of the Pilot Program, and thus is in the public interest. In addition, the goal of the Pilot Program is to stimulate deployment of the broadband infrastructure necessary to support innovative telehealth and, in particular, telemedicine services to those areas of the country where the need for those benefits is most acute.

The

- growth in total USF disbursements is correlated to CETC support seems quite straightforward: if one component of the total is growing rapidly, the total will grow rapidly unless there are offsetting declines in other components. Two of the other three USF programs are already subject to annual funding caps, see47 C.F.R. § 54.507(a) (schools and libraries program); 47 C.F.R. § 54.623 (rural health care program), and the other program, low-income support, although not capped, did not grow at an alarming rate from 2001 to 2007, seeUNIVERSALSERVICE MONITORING REPORT tbl.2.2. Thus, it is clear high-cost support, which has grown by $1.7 billion in the past six years, is the driving force behind the growth in total USF support. Moreover, the growth in

- sections in this subpart that appear to have expired by their own terms. For example, section 54.604(a)(2) addresses contracts signed after July 10, 1997 but ``before the date on which the universal service competitive bid system described in [section 54.603] is operational.'' Because it appears that this time period has expired, we propose to delete this provision. Similarly, sections 54.604(d), 54.623(b), and 54.623(c)(2) and (3) contain provisions that appear to no longer be applicable. We therefore seek comment on whether they should be repealed in whole or in part. We also propose modifying section 54.623(c)(4) by adding language to reflect that applications submitted within subsequent filing periods will be treated as simultaneously received. We seek comment on these proposals. Part 63

We estimate that these facilities could receive up to $12,000 each for the Funding Year ending June 30, 2006. Thus, this would have approximately a $28 million impact on the rural health care fund. See 47 C.F.R. § 54.623. The Administrator estimates that the demand will be approximately $30 million for Funding Year 2004. See Federal Universal Service Support Mechanisms Fund Size Projections for the First Quarter 2005, available at (filed Aug. 2, 2005). We also limit this additional support to Funding Year 2005. We also conclude that the administrative corporations will determine the length of the window and resolve other administrative issues necessary to implement our decision to adopt a window filing period consistent with our guidance set forth below. Therefore, we amend sections 54.507(e) and 54.623(c) of our rules to implement this change. In addition, we delegate authority to the Chief, Common Carrier Bureau to resolve unanticipated technical and operational issues relating to the new universal service mechanisms that may arise in the future. 2.

We seek comment on these proposals. Part 63

- 2,300 health care providers, including American Red Cross shelters, that are eligible for funding under this Order based on their geographic location. As such, this support will not fund basic telephone services, sometimes known as POTS.
