- payments simply due to the timing and frequency of previous requests for funding for internal connections. We limit this relief to schools and libraries in the Hurricane Katrina disaster area that incurred substantial damage as a result of the hurricane. Accordingly, for the reasons stated above, we find that due to this natural disaster, good cause exists for waiving section 54.506(c) for affected entities and that such waiver is in the public interest. To qualify for this waiver, parties should submit a request describing the damage incurred to the equipment that needs to be replaced. Service substitution requests. - C.F.R. 54.507(c). The Administrator determined to close the filing window for FY 2006 on February 16, 2006. Therefore, Petitioners seek an extension of the FY 2006 filing window to ensure that schools and libraries in the Katrina-affected areas that were directly affected by Hurricane Katrina are able to apply for and receive E-rate funding for FY 2006. Id. 54.506(c). The Commission used its ancillary authority under Title I to include a free wireless handset. See Hurricane Katrina Order, para. 13. The Commission estimated that this special relief would have approximately a $39 million impact on the low-income fund, based on an estimated $130 per approximately 300,000 eligible evacuee households without telephone service. - ESL Commission's Rules Regarding Eligible Services. In the ESL NPRM, we sought comment on whether we should reorganize or restructure the rules relating to eligible services and the ESL to better inform applicants of which services are supported. Currently, sections 54.502 and 54.503 of the Commission's rules state that telecommunications carriers may provide telecommunications, Internet access, and internal connections; section 54.506 defines internal connections; section 54.517 provides that non-telecommunications carriers may provide voice mail, Internet access, and internal connections; and section 54.518 describes the wide area network services that will be supported. We tentatively conclude that the rules should be restructured so that all of the provisions relating to eligible services can be located in the same place and seek comment

We seek comment on a revised discount matrix for internal connections and ask whether we should adjust the current level of additional discount provided to rural schools and libraries. Commenters should set forth with specificity an alternative proposed discount matrix. Eliminate the 2-in-5 Rule. We seek comment, in conjunction with the options detailed above, on eliminating section 54.506(c), the 2-in-5 rule, which limits an eligible entity's receipt of discounts on internal connections to twice every five funding years. In the Schools and Libraries Third Report and Order, the Commission sought to make funds for internal connections available to more eligible schools and libraries on a regular basis by limiting the frequency with which applicants may receive priority two

- the requested services were ineligible because the applicants' contracts included services that went beyond basic maintenance of internal connections. Based on the record before us, however, it appears that petitioners have been denied support for some eligible basic maintenance services. To the extent necessary, we find that good cause exists to justify waivers of the requirement imposed pursuant to section 54.506(b) that a technical support contract providing for more than basic maintenance services be deemed ineligible for discounts. We also waive section 54.504(d) to permit petitioners to remove ineligible basic maintenance services from their funding requests. Finally, we eliminate the requirement, beginning funding year 2011, that a technical contract that provides for more than basic maintenance services shall be deemed ineligible
