Waiver of sections 36.611 and 36.612 will allow Mescalero to immediately begin receiving high-cost loop support based upon projected costs, rather than historical costs. In a companion order released today, the Commission grants Mescalero's request for waiver of section 54.305 of the Commission's rules. Waiver of section 54.305 of the Commission's rules will enable Mescalero to receive high-cost universal service support based on the average cost of the lines under its ownership, rather than receiving the same per-line levels of high-cost support for which the acquired access lines were eligible prior to their transfer from Valor. The Commission began applying the one-percent guideline in 1995 to limit the potential adverse impact of exchange sales on the overall fund, also recognizing that, because high-cost loop support is capped, an increase in the draw of any fund recipient necessarily reduces the amounts that other LECs receive from the fund. After adoption of section 54.305 of the Commission's rules, the one percent guideline was not, in practice, a necessary limitation for most study area waivers with respect to high-cost loop support and local switching support, because section 54.305 provides that a carrier purchasing exchanges from an unaffiliated carrier is permitted to receive only the same level of per-line high-cost support that the selling company was

WCB staff recommends that the Commission eliminate certain sections in Part 36 and Part 54. Staff also recommends the elimination of certain regulations in Part 64, Subpart A. Other recommendations. Although WCB staff recommends retaining section 54.305(a), staff recognizes that issues addressed by this rule have been referred to the Federal-State Joint Board on Universal Service. WCB staff recommends, therefore, that the Commission await the recommendation of the Joint Board before addressing USTA's comments recommending elimination of section 54.305(a). CONCLUSION This Staff Report describes the Bureau's thorough review of the Commission's regulations pertaining to wireline telecommunications that

The Petitioners argue that the proposed transaction between EMC and Direct Communications will not have an adverse effect on universal service because section 54.305(b) limits an acquiring carrier to the same per-line high-cost support levels for which those exchanges were eligible prior to the transfer of the exchanges. The Commission amended section 54.305, a rule governing the safety valve mechanism, so that calculation of the support that a rural carrier receives includes recognition of investments in newly acquired exchanges. This change was intended to effectuate the Commission's intent when it adopted the safety valve mechanism of encouraging substantial investments in rural exchanges. The Commission took this action to prevent incumbent LECs from establishing separate study areas made up only of high-cost exchanges to maximize their receipt of high-cost universal service support. A carrier must therefore apply to the Commission for a waiver of the study area boundary freeze if it wishes to transfer or acquire additional exchanges. Universal Service Support. Section 54.305(b) of the Commission's rules provides that a carrier acquiring exchanges from an unaffiliated carrier shall receive the same per-line levels of high-cost universal service support for which the acquired exchanges were eligible prior to their transfer. This rule is meant to discourage a carrier from acquiring an exchange as a way to increase its share of high-cost universal service support.

We conclude that several issues, such as appropriate reforms for the LTS program, should be addressed in the context of our pending proceedings for rural high-cost reform and/or interstate access charge reform for rate-of-return carriers. In the attached Further Notice of Proposed Rulemaking, we seek comment on the narrow issue of whether to continue to apply section 54.305 of the Commission's rules to transfers of telephone exchanges between non-rural carriers following the phase-down. Section 54.305 requires a carrier that acquires an exchange to step into the seller's shoes for universal service support purposes. The Commission adopted the rule in 1997 as a stopgap measure to prevent carriers receiving support based on the size of their study areas and

The MAG plan also would eliminate the all-or-nothing rule: carriers may retain non-price cap status when they become affiliated with price cap carriers, or acquire lines, exchanges, or study areas from price cap carriers. In addition, the MAG plan would eliminate section 54.305 of the Commission's rules, which limits universal service support for acquired telephone exchanges to the support received by the seller. By modifying safety net support in this way, we ensure that carriers that meet the threshold requirement for eligibility will receive support for their incremental investment, but do not recover more than the costs incurred as a result of the additional investment. The order took steps to rebase and modify the high-cost support mechanism during the plan's five-year life, providing rural carriers with certainty and stability and enabling them to continue to provide supported services at affordable rates to consumers. Among other reforms, the Commission modified section 54.305 of the Commission's rules, which governs support for sold or transferred exchanges, to create a ``safety valve'' mechanism that provides support for additional investment made in acquired exchanges. The Commission also adopted a ``safety net additive,'' which provides additional support to rural carriers that make significant new investment in infrastructure. Recognizing that ``rural carriers generally serve fewer subscribers, serve more sparsely populated areas, and do not generally benefit as much from economies of scale and scope,'' the Commission concluded in the First Report and Order that a gradual shift to a forward-looking economic cost methodology was appropriate for rural carriers. Section 54.305 was adopted in the First Report and Order as a temporary measure aimed at discouraging carriers from transferring exchanges merely to increase their share of high-cost universal service support during the Commission's transition to universal service support mechanisms based on the forward-looking economic cost of operating a given exchange. The Commission was concerned that, until support for all carriers is

The Commission also asked the Joint Board both to revisit the definition of ``rural telephone company'' for high-cost universal service support purposes and to consider consolidating multiple study areas within a state. Finally, the Commission requested that the Joint Board consider whether to retain or modify section 54.305 of the Commission's rules, which concerns the amount of universal service support for transferred exchanges. By this Public Notice, the Joint Board initiates its review. As set forth below, we invite public comment on whether these rules continue to fulfill their intended purposes, whether modifications are warranted, and if so, how the rules should be modified. Background In the 1996

- as this nation builds on what has been accomplished to-date. The Joint-Board's first objective in this proceeding should be to preserve and enhance what has been accomplished. We should strive to further the ``no barriers'' approach to deployment of advanced services articulated by the Rural Task Force, whose work we are in part revisiting. It is possible that the Section 54.305 rules concerning treatment of transferred exchanges may continue to create unintended but substantial barriers to essential upgrades of property acquired by carriers committed to investing in order to provide top notch service. These rules may exacerbate the effects on some rural areas, formerly or currently served by ``non-rural'' carriers, of certain policies adopted by the Commission for non-rural companies serving

In deciding a petition for reconsideration, the Commission amended section 54.305 of its rules, which governs the safety valve mechanism, to make it consistent with the Commission's intent in adopting the safety valve mechanism, which is to provide additional support to rural carriers that make substantial investment after acquiring exchanges. By modifying safety net support in this way, we ensure that carriers that meet the threshold requirement for eligibility will receive support for their incremental investment, but do not recover more than the costs incurred as a result of the additional investment. Consistent with the Rural Task Force's recommendation, we retain section 54.305 of the Commission's rules, which provides that a carrier acquiring exchanges from an unaffiliated carrier shall receive the same per-line levels of high-cost support for which the acquired exchanges were eligible prior to their transfer. We modify the rule, however, to provide a ``safety valve'' that provides support for additional investment made in the acquired exchanges. We decline at this

The petitioners submitted a letter from the New Mexico Public Service Commission indicating that it does not oppose the grant of the requested study area waiver. In addition, Mescalero seeks a waiver of section 54.305 of the Commission's rules, 47 C.F.R. 54.305, to enable Mescalero to receive high-cost universal service support based on the average cost of its own lines, rather than receiving the same per-line levels of high-cost support for which the acquired access lines were eligible prior to their transfer.
