As specified in the Order, however, any new reporting requirements are not effective until Federal Register publication of approval by the Office of Management and Budget of the associated information collections under the Paperwork Reduction Act (PRA). Additional Eligibility Requirements. TracFone either satisfies the applicable eligibility requirements set forth in the ETC Designation Order, described above, or must make such showings in its first annual report under section 54.209 of the Commission's rules. Public Interest Analysis We find that TracFone's universal service Lifeline offering will provide a variety of benefits to Lifeline-eligible consumers including increased consumer choice, high-quality service offerings, and mobility. In addition, the prepaid feature, which essentially functions as a toll control feature, may be an attractive alternative to Lifeline-eligible consumers who are concerned about usage charges

We find that reliance on Virgin Mobile's commitments to meet these requirements is reasonable and consistent with the public interest and the Act and the Fifth Circuit decision in Texas Office of Public Utility Counsel v. These annual reporting requirements should provide the factual basis underlying the annual section 254(e) certification by the state commission (or ETC in the case of federally designated ETCs) by October 1 of every year that support is being used for the intended purposes. Reporting Requirements Background. In 2005, the Commission adopted section 54.209, which requires federally-designated ETCs to submit an annual report to the Commission including: a progress report on their five-year build-out plans; data and explanatory text concerning outages, unfulfilled requests for service, complaints received; and certifications of compliance with applicable service quality and consumer protection standards and of the ability to function in emergency situations. As noted above, since the Commission

Fourth, we delete section 54.209 of our rules regarding certification and reporting obligations for federally-designated ETCs, while moving those reporting requirements relevant to ETCs providing Lifeline services to subpart E, which governs universal service support provided to low-income consumers. In the USF/ICC Transformation Order and FNPRM, the Commission indicated that recipients of high-cost support would henceforth report pursuant to new section 54.313, and section 54.209

As the Bureau clarified in the USF/ICC Clarification Order, competitive ETCs that have been designated by the Commission are required to file information with respect to their provision of voice service during 2011, as previously required by section 54.209 of the Commission's rules. These competitive ETCs, who have been subject to these reporting obligations since Commission designation, are not subject to new reporting obligations, and we therefore do not find it unreasonable to continue to impose this reporting obligation. More generally, all competitive ETCs are required to offer voice service throughout the designated study area, and the Commission has
