The Proposal represents our consensus view of the best process for selection of an LNPA(s) to provide the neutral, technologically proficient, and cost-effective administrative services that are necessary for achieving the important pro-consumer and pro-competitive purposes of local number portability (``LNP''). Significantly, the Proposal reflects the requirements of Sections 52.25 and 52.26 of the FCC's current rules, including the report to the Commission prepared by the NANC's LNPA SWG, dated April 25, 1997 (``Working Group Report''), which is incorporated by reference in Section 52.26(a) of the Commission's rules. The PRoposal Reflects the Current Delegations of Authority and FCC rules Regarding LNPA Selection Under the Commission's existing rules, the NANC has oversight authority

- Notice needed to be issued noting the changes to the flows since they are going to be a part of the FCC Rules. Mr. Williams responded that he was not familiar with the process, but was sure that the FCC would need to review the changes before making them a part of the FCC Rules. Mr. O'Connor stated that Section 52.26 of the FCC Rules point to the report that contains the original flows, and that Rule adopts those flows to be the correct flows. He opined that if there are changes to the flows, they would have to be adopted by the FCC to replace what is already in the Rules. Chairman Atkinson inquired as to whether there is a

A 30-day advance notice is required unless good cause is shown. Mr. Williams as the DFO will have the responsibility of getting approval to have an Executive Session. Chairman Atkinson further advised that under Section 52.26 of the FCC Rules (NANC Recommendations on Local Number Portability Administration, Section A3), ``the NANC shall provide ongoing oversight of number portability administration, including oversight of the regional LLCs subject to Commission review. Parties shall attempt to resolve issues regarding number portability deployment among themselves, and, if necessary, under the auspices of the NANC. If any party objects to the

I think the experts with the contract are at the LLC, and I think that given what I've heard today, these are issues that need to be resolved in-house at the LLC first before they're at the NANC. Thank you. CHAIRMAN: Yes. And 52.26(b)3 says parties shall attempt to resolve between themselves, but it does allow the NANC outlet to a certain extent. Again, I don't want to cut off discussion on this, but we do have an obligation to let the people who are working here leave and clean up before the government closes. So I do appreciate everyone coming out today. And

- the characterization that this represents consensus of an industry. MR. KOUTSKY: A couple of points I'd like to make in terms of this matter. The one point I would like to stress is that we are charged, NANC is charged with overseeing the Number Portability Administration in the United States. The NAPM is given immediate oversight over that. Commission rule 52.26B I think is fairly clear as to what the structures are, which is NAPM is for the lower, NANC is in the middle, and all of this is subject to actually C review. I do want to stress that I don't view these as private contracts between private parties. I believe this is a contract that does the public's business,

Change Orders 429, 430, and 435 provide for the inclusion in the Number Portability Administration Center ("NPAC") database and provision through that database of Uniform Resource Identifier ("URI") fields for Voice, Multimedia Messaging Service ("MMS"), and Short Messaging Service ("SMS"). The request was submitted by Telcordia Technologies, Inc. ("Telcordia") on May 26, 2009, pursuant to Section 52.26(b)(3) of the Federal Communications Commission ("FCC" or "Commission") rules. Telcordia challenges the adoption of these change orders on both substantive and procedural grounds. Substantively, Telcordia argues that the change orders are defective because it believes that the URI fields do not meet with the Section 52.25(f) requirement that information in the number portability databases "shall be limited to the information

We required the LNPA to allocate the costs of each regional database among carriers in proportion to each carrier's intrastate, interstate, and international end-user telecommunications revenues attributable to that region. On August 18, 1997, the Commission adopted and incorporated into its rules the NANC's recommendation for the provisioning process flows. The provisioning flows submitted by the NANC that we adopt in this Order supersede and replace those that the Commission incorporated by reference into section 52.26(a) of its rules in 1997. As a result, we revise our rules accordingly to exclude the outdated provisioning flows. The Commission also adopted in 1997 the NANC's recommendation of a four-business day porting interval for wireline ports, which covered both simple and non-simple ports. As discussed above, the Commission's Porting Interval Order reduced the porting interval for simple wireline and
