USTelecom contends this ``would enable ILECs and their auditors to more efficiently prepare and audit ILEC accounts, and would result in a more useful product for the Commission and its staff.'' USTelecom also advocates the elimination of section 32.27, governing valuations of services and assets transferred between regulated and non-regulated affiliates. USTelecom asserts that: (1) customers expect bundles of services that require inputs from affiliates; (2) affiliate transaction rules involve cost allocations that may negatively affect their ability to price these services in a competitive market; and (3) competition has removed any cost-shifting and cross-subsidy concerns. The Affiliate Transactions Rules. When a common carrier does business with a nonregulated affiliate, it must record the transaction pursuant to Part 32 of our rules. Specifically, section 32.27 of the Commission's rules requires ``transactions with affiliates involving asset transfers into or out of the regulated accounts [to be] recorded'' according to a hierarchy of rules. Similar rules apply to certain non-tariffed services provided between a carrier and its affiliate. The Cost Allocation Methodology Adopted by BellSouth. USTA proposes that the Commission revise section 32.27(d) to decrease the threshold from 50 percent to 25 percent for use of prevailing price in valuing affiliate transactions. USTA contends that this proposed change in threshold would be consistent with a more competitive environment. We seek comment on USTA's proposal. - Commission: INTRODUCTION In this Order, we deny Moultrie Independent Telephone Company's (Moultrie) petition for declaratory ruling, request for waiver of Part 36, and motion for stay. Moultrie seeks a ruling regarding the regulatory accounting and separations treatment of ``sale and lease-back'' arrangements between itself and an affiliate. We disagree with Moultrie's contention that there is a ``patent ambiguity'' between sections 32.27(a) - (c) and 36.2(c)(2) of the Commission's rules and, thus, decline to approve Moultrie's proposed accounting treatment of its sale and lease-back arrangement with its affiliate for jurisdictional separations and high-cost loop support purposes. Accordingly, with respect to the sale and lease-back transaction, we direct Moultrie to include the property and related expenses with, and exclude the related rent expenses

After reviewing the record, we adopt USTA's proposal. The purpose of the Commission's threshold is to ensure that sufficient transactions occur with unaffiliated parties to produce a reasonable surrogate of a true market price. On August 4, 1999, the Bureau responded to NECA's request by indicating that, for calculating USF expense adjustments, Moultrie's sale/lease-back arrangement as described by NECA should be accounted for under section 36.2(c)(2), i.e., by including the property and related expenses with, and excluding the rent expenses from, the carrier's regulated

I. INTRODUCTION In this Notice of Apparent Liability for Forfeiture, we find that the Verizon Telephone Companies (``Verizon'') apparently violated section 32.27(c) of the Commission's rules, which regulates accounting practices for transactions between Verizon's New York Bell Operating Company (``BOC'') and its affiliates established pursuant to section 272(c) of the Communications Act of 1934, as amended (``the Act''). This rule is important because it helps to ensure that Verizon's affiliates do not receive better treatment than Verizon's competitors. We find that Verizon

I. INTRODUCTION 1. In this Notice of Apparent Liability for Forfeiture, we find that the Verizon Telephone Companies (``Verizon'')1 apparently violated section 32.27(c) of the Commission's rules, which regulates accounting practices for transactions between Verizon's New York Bell Operating Company (``BOC'') and its affiliates established pursuant to section 272(c) of the Communications Act of 1934, as amended (``the Act''). This rule is important because it helps to ensure that Verizon's affiliates do not receive better treatment than Verizon's competitors. We find that Verizon

In this Order, we adopt a Consent Decree terminating investigations into possible violations by the Verizon telephone companies (``Verizon'') of section 272 of the Communications Act of 1934, as amended, 47 U.S.C. 272, and sections 32.27 and 53.203 of the Commission's rules, 47 C.F.R. 32.27, 53.203. The investigations concern Verizon's compliance with certain structural, transactional, and nondiscrimination safeguards applicable to transactions between Verizon's Bell Operating Companies and its other incumbent local exchange carriers, on the one hand, and Verizon's separate in-region, interLATA affiliates established pursuant to section 272 of the Act, on the other.1 2. The affiliate transactions rules prescribe the manner in which incumbent LECs record the costs of transactions between regulated and nonregulated affiliates on their books of account, and thereby help ensure that such transactions occur at arm's length. See 47 C.F.R. § 32.27. The cost allocation rules prescribe the manner in which incumbent LECs must separate the costs of activities regulated under Title II from the costs of nonregulated activities performed directly by the incumbent LEC. 47 C.F.R. §§ 64.901-904. - services subject to the exception, may deprive carriers of many of the benefits of the exception. A cap is unnecessary because the independent auditors and the Commission will continue to monitor how carriers define services, thereby reducing the risk that the exception will be abused. We therefore adopt the $500,000 per service, per year de minimis exception to our section 32.27(c) good faith estimate requirement. Based on our experience enforcing the affiliate transactions rules, we conclude that the $500,000 threshold is reasonable. We find that below this threshold, the administrative cost and effort of making such a determination will outweigh the regulatory benefits of the good faith determination of fair market value of a service. Adopting this $500,000 de minimis exception

- Acct. No. 200332080014 ) Verizon Telephone Companies, Inc. ) FRN No. 0008988438 ORDER Adopted: July 23, 2004 Released: July 27, 2004 By the Commission: 1. As a result, on September 8, 2003, the Commission issued a Notice of Apparent Liability for Forfeiture to Verizon for various apparent violations of section 32.27(c) of the Commission's rules.8 The NAL proposed a forfeiture of $283,000, pursuant to section 220(d) of the Act,9 and admonished Verizon for apparent violations of section 272(b)(5) of the Act10 and section 53.203(e) of the Commission's rules11 that had occurred outside the statute of limitations.12 Verizon filed its response to the NAL on October 8, 2003.13 5.
