On April 15, 2004, an agent of the Commission's Chicago Office inspected the antenna structure, ASR# 1042535, located at Carlinville, Illinois, and observed the following violation(s): 5.a. 47 C.F.R. 17.17(a): ``...structures authorized prior to July 1, 1996 ... retain their present painting and lighting specifications...'' The Antenna Structure Registration, FCC Form 854, specifies the structure listed above is required to have red obstruction lighting. - lighting specifications contained in the FAA Advisory Circular specified in its ASR in willful and repeated violation of Section 17.23 of the Rules, 47 C.F.R. 17.23. We note, however, that Section 17.23 applies only to new and altered antenna structures registered on or after January 1, 1996, not to existing structures authorized prior to July 1, 1996. Haviland states that its counsel promptly submitted a formal request to the FAA for authorization to utilize white strobe lighting in lieu of painting and red obstruction lighting. 5. Next, Haviland argues that Section 17.17(a) of the Rules implies a grandfathering of tower marking and lighting as it existed prior to July 1, 1996.
