- wall imaging systems, the requirement for coordination with Federal radio systems could be reduced. Harmful interference consists of interference to a radiocommunications service. See 47 C.F.R. § 15.3(m). Part 15 devices are not part of a ``service.'' Thus, interference caused to a Part 15 device by another Part 15 device does not constitute harmful interference. See 47 C.F.R. §§ 15.509(b), 15.511(b), and 15.513(b). The GPRIC consists of Geophysical Survey Systems, Inc., Mala Geoscience, Inc., and Sensors & Software, Inc. These parties manufacture GPRs and, according to the petition, account for over 95 percent of the GPRs sold in the U.S. The GPRIC requests for reconsideration will be addressed in a separate order dealing with several petitions for reconsideration and their associated

On July 18, 2003, Vista Controls, a Curtiss-Wright Company, filed a request for waiver of Sections 15.209, 15.511 and 15.521 of the Comission's rules to permit it to obtain authorization for, and to market, its ultra-wideband (``UWB'') surveillance system know as QUPID. This petition was placed on notice for public comment on August 11, 2003, DA 03-2631. Comments were due by September 10, 2003, and replies were due by September 25, 2003. 2. It can be programmed to respond only to pedestrians or vehicles or only to vehicles operating above a certain size or speed. The UltraVision surveillance system complies with all of the emission limits specified in Section 15.511 of the regulations. However, it does not operate within the 1990-10600 MHz band as required under Section 15.511(a). UltraVision also requests that the categories of parties eligible to operate UWB surveillance systems, as specified in Section 15.511(b), be expanded to permit operation by any entity eligible for licensing under the Part 90 regulations. - Office of Engineering and Technology: On October 6, 2006, UltraVision Security Systems, Inc. (``UltraVision'') filed a request for a waiver of Part 15 of the Commission's rules to permit the marketing and operation of an ultra-wideband (``UWB'') surveillance system that operates below 700 MHz. The UltraVision Surveillance system does not operate within the 1990-10600 MHz band as required under Section 15.511(a), although it otherwise complies with the emission limits of that rule. UltraVision also requests that the categories of parties eligible to operate UWB surveillance systems, as specified in Section 15.511(b), be expanded to permit operation by any entity eligible for licensing under the Part 90 regulations. On October 24, 2006, the Commission issued a Public Notice on UltraVision's Request for

Embedded Computing (``CWCEC'') to permit the certification and subsequent marketing and operation of a limited number of units of its Quick Reaction Perimeter Intrusion Detection (``QUPID'') fixed surveillance ultra-wideband (``UWB'') imaging system. CWCEC requests a waiver of the average and peak emission limits in rule Sections 15.511(c) and (e) for its QUPID transmitter. We find that a grant of this waiver would allow for the operation of devices that support homeland security by providing protection from terrorist acts and other undesired intrusions to high risk, secured facilities. While we are permitting CWCEC's QUPID transmitter to operate at higher emission levels than allowed by our rules, we are

- locations identified by the Government. This should provide maximum flexibility to safety services while still assuring that the risk for harmful interference is appropriately minimized. Surveillance systems will operate only at fixed locations such that harmful interference can be avoided through coordination. In addition, if harmful interference were to occur the source can be readily identified and corrected. See Section 15.511 for the specific technical provisions for mid-frequency UWB devices. The limits specified above for imaging systems reflect an abundance of caution to protect the GPS and PCS services, and the passive bands employed in radio astronomy and by satellite sensors. We believe that by restricting the parties and requiring coordination before the device is used that the proliferation of these

Finally, we note that the new public safety imaging system incorporates provisions that permit the use of through-wall imaging systems at emission levels more lenient than those that were adopted under the R&O. Accordingly, we are eliminating the separate provisions for mid-frequency through-wall imaging systems in 47 C.F.R. § 15.511 as it is redundant with the new provisions for public safety imaging systems. The specific regulations being adopted to permit this expanded UWB application are shown in Appendix B. At this time, we are not adopting changes to the rules to implement the tracking or communication system suggested by Time Domain. In its petition, Time Domain indicated its desire to
