Due to the need to protect incumbent fixed microwave operations in the band, our rules distinguished between coordinatable and noncoordinatable PCS devices, and Section 15.307 of the Rules outlines the procedures by which UTAM coordinates the deployment of such devices. Because UTAM has taken the necessary steps to deploy UPCS equipment throughout the 1920-1930 MHz band by providing notification to the remaining microwave licensees in that band, the need for coordination will cease to exist after April 4. Accordingly, we will begin accepting applications for

- transition of the 1920-1930 MHz band from incumbent fixed microwave operations to UPCS use. The rules the Commission adopted to implement this process were to sunset after a ten-year period. Because the need for UPCS devices to protect fixed microwave incumbents in the 1920-1930 MHz band sunset on April 4, 2005, on our own motion, we propose to remove Section 15.307 of the Rules. In proposing this change, we note that with the sunset of the requirement that UPCS devices protect fixed microwave incumbents in the UPCS band, it is no longer necessary to 1) distinguish between coordinatable and non-coordinatable UPCS devices under the equipment authorization process, as specified in Section 15.307(c); 2) require a coordinatable UPCS device to incorporate certain

It additionally sought comment on removing Sections 15.303(b) and (e), 15.307, and 15.311 regarding coordination with UTAM, Inc., since the relocation of incumbent fixed services from the band is now complete. The Commission further sought comment on a number of proposed updates to the Part 15 UPCS rules regarding measurement procedures and definitions.
