A list of the companies whose petitions we dismiss is provided in the Attachment. The record in this proceeding indicates that these companies are now in compliance with Section 11.51. Their petitions for waiver are therefore moot. Accordingly, IT IS ORDERED that the pending requests

According to Omni's program logs, no weekly tests were transmitted between January 28 and February 17, 2008. Licensees are not informed of the exact time at which monthly EAS tests are sent. Similarly, licensees cannot predict when actual emergencies will occur. See 47 C.F.R. 11.51(k)(2). Although Omni asserts that its station was staffed by personnel during the times the station was in operation, its staff was not closely monitoring for EAS monthly tests, as the station failed to transmit any monthly EAS tests between January and June 2007. KFTU was also multicasting, using a second program stream to provide Univision programming to the viewing public. Any viewers of this program stream would have been unaware of any EAS alerts or messages, as no EAS equipment was connected. As stated in 11.51(c) of the Rules, all DTV broadcast stations must transmit EAS messages on all program streams. The engineering staff of KFTU acknowledged to the San Diego agents that KFTU's EAS equipment may have been experiencing technical problems on the day of the inspection, and admitted that the second program stream had no connection to KFTU EAS equipment. - OF APPARENT LIABILITY FOR FORFEITURE Adopted: June 6, 2011 Released: June 7, 2011 By the District Director, Atlanta Office, South Central Region, Enforcement Bureau: INTRODUCTION 1. In this Notice of Apparent Liability for Forfeiture (``NAL''), we find that Comcast of Alabama, Inc., (``Comcast''), operator of a cable television system in Florence, Alabama, apparently willfully and repeatedly violated sections 11.35(a) and 11.51(h) of the Commission's rules (``Rules'') by failing to ensure that emergency alerts system (``EAS'') messages were transmitted properly to certain customers. We conclude that Comcast is apparently liable for a forfeiture in the amount of sixteen thousand dollars ($16,000). BACKGROUND 2. On January 3, 2011, the Enforcement Bureau's Atlanta Office (``Atlanta Office'') received a complaint that a Comcast customer in

However, as JMK points out, WPWC's EAS equipment is installed at the station's transmitter site and operates automatically with the capability of a remote control override. WPWC's EAS set-up is consistent with Section 11.51(m) of the Rules which permits automatic operation of the EAS system by broadcast stations that use remote control. Further, although the NAL appears to cite JMK for not monitoring its primary EAS source and having its EAS equipment improperly tuned to its secondary EAS source, no separate violation of Section 11.52(d) of the Rules was noted. The Petersons argue that their method sharing of EAS equipment, and running EAS tests, with a station which was previously co-owned with KBSZ(AM) was in ``technical compliance'' with the Commission's EAS Rules. This is incorrect. As the San Diego Office correctly stated in the NAL, Section 11.51(j) of the Rules allows broadcast stations that are co-owned and co-located with a combined studio or control facility to provide EAS for the combined stations with one EAS encoder. Section 11.51(j), however, does not contemplate stations that are co-located, but not co-owned, sharing EAS equipment. In the present case, KBSZ(AM) and KSWG(FM) are neither co-owned nor co-located. Although Omni asserts that its station was staffed by personnel during the times the station was in operation, its staff was not closely monitoring for EAS monthly tests, as the station failed to transmit any monthly EAS tests between January and June 2007. As stated in 11.51(c) of the Rules, all DTV broadcast stations must transmit EAS messages on all program streams. In the Town of Middlebury, however, Petitioner's household share is under 15 percent (11.51 percent, to be precise). There, it is possible that one of the DBS providers is the largest MVPD and that the combined share of the other DBS provider and Petitioner is not in excess of 15 percent.

When facilities are unattended, Sections 11.51 and 11.52 of the Rules require licensees to employ automatic systems to interrupt programming and transmit certain EAS messages. The requirement that stations monitor, receive and retransmit the required EAS tests ensures the operational integrity of the EAS system in the event of an actual disaster. Appropriate entries must be made in the broadcast station log as specified in Sections 73.1820 and 73.1840, indicating reasons why any tests were not received or transmitted. Section 11.51(j) of the Rules states that broadcast stations that are co-owned and co-located with a combined studio or control facility may provide EAS for the combined stations with one EAS encoder. Section 11.51(j), however, does not contemplate stations that are co-located, but not co-owned, sharing EAS equipment. In the present case, KBSZ(AM) and KSWG(FM) are not currently co-owned or co-located. Therefore,

- we reduce the modulation level of the EAS codes from 80% to 50% of full channel modulation limits. SBE states that in most cases the tone insertion equipment must be inserted after station processing to attain the required modulation level. According to SBE, this situation is ``adverse to acceptable engineering practice.'' We agree with SBE and propose to amend Section 11.51(f) of the Rules to permit a minimum modulation level of 50%. We invite comment on this proposal. Compatibility of EAS Equipment with NWR-SAME System NWS requests that we amend Section 11.33(a)(4) and (a)(5) of the Rules to permit EAS decoders to display or log receipt of only those event codes and accompanying location codes for which the decoder is programmed

- synchronize the EAS audio feed with their video feeds. We agree with commenters that the public interest will be served by amending Part 11 to allow broadcast stations to provide the highest quality audio available to them during a national emergency. Because National Primary broadcast stations will still be required to relay all national EAS messages in accordance with Section 11.51 of the Rules, this amendment will not compromise the integrity of the EAS system or prevent those broadcast stations that do not have access to alternative audio feeds from transmitting presidential EAS messages to the public. One commenter cautions that we must ensure that lengthy delays do not result because broadcast stations are waiting for audio feeds from alternative sources.

Because National Primary broadcast stations will still be required to relay all national EAS messages in accordance with Section 11.51 of the Rules,127 this amendment will not compromise the integrity of the EAS system or prevent those broadcast stations that do not have access to alternative audio feeds from transmitting presidential EAS messages to the public. 59. Further, although the NAL appears to cite JMK for not monitoring its primary EAS source and having its EAS equipment improperly tuned to its secondary EAS source, no separate violation of Section 11.52(d) of the Rules6 was noted. The Petersons argue that their method sharing of EAS equipment, and running EAS tests, with a station which was previously co-owned with KBSZ(AM) was in "technical compliance" with the Commission's EAS Rules. Therefore, KBSZ(AM) is

According to Omni's program logs, no weekly tests were transmitted between January 28 and February 17, 2008. Licensees are not informed of the exact time at which monthly EAS tests are sent. Similarly, licensees cannot predict when actual emergencies will occur. See 47 C.F.R. S: 11.51(k)(2). Although Omni asserts that its station was staffed by personnel during the times the station was in operation, its staff was not closely monitoring for EAS monthly tests, as the station failed to transmit any monthly EAS tests between January and June 2007. In this Notice of Apparent Liability for Forfeiture ("NAL"), we find that Comcast of Alabama, Inc., ("Comcast"), operator of a cable television system in Florence, Alabama, apparently willfully and repeatedly violated sections 11.35(a) and 11.51(h) of the Commission's rules ("Rules") by failing to ensure that emergency alerts system ("EAS") messages were transmitted properly to certain customers. We conclude that Comcast is apparently liable for a forfeiture in the amount of sixteen thousand dollars ($16,000). II. BACKGROUND 2. 59. In the alternative, Atlantic Beach Radio suggests that if we do find that it violated the Rules, we should only find a minor violation here. 9. Under Section 11.51(j) of the Rules,11 broadcast stations that are co-owned and co-located with a combined studio or control facility may provide the EAS transmitting requirements contained in Section 11.51 of the Rules12 for the combined stations with one EAS encoder.13 The moment that WMIR(AM) and WKVC(FM) were no longer co-owned, the stations were no longer permitted to share the EAS unit under

- APPARENT LIABILITY FOR FORFEITURE Adopted: June 6, 2011 Released: June 7, 2011 By the District Director, Atlanta Office, South Central Region, Enforcement Bureau: I. INTRODUCTION 1. On January 3, 2011, the Enforcement Bureau's Atlanta Office ("Atlanta Office") received a complaint that a Comcast customer
