(last visited Oct. 29, 2010). See 47 C.F.R. § 11.34. One commenter to the Part 11 PN noted: ``since FEMA is not adopting the Implementation Guide, they are likewise not testing in their Conformance Lab for equipment adherence to this Implementation Guide. It would seem then, since non-adherence could result in lack of detection of duplicate messages in the Commission's legacy EAS network, that the FCC should then require equipment

- NSBA states that the Commission should ``require all encoder/decoder manufacturers to officially certify that their equipment performs each of the required steps to receive, record, and rebroadcast an EAS message and more specifically, an EAN. We do not agree. TFT correctly notes that the ``Commission already has rules in place for handling of EAN Event code messages.'' Pursuant to section 11.34 of our rules, all EAS equipment must be certified to ``show the capability of the equipment to meet the requirements of this part.'' For purposes of national testing, which for the vast majority of EAS participants, for the foreseeable future, will continue to involve receipt and transmission of a SAME-formatted EAN, we agree with TFT that requiring manufacturers to recertify

How could any requirements we might consider with respect to amending section 11.54 be tailored to impose the least amount of burden on those affected? To the extent feasible, what explicit performance objectives should we specify to facilitate monitoring the success of any potential course of action? EAS Equipment Certification Section 11.34 of the Part 11 rules requires EAS encoders and decoders to be certified in accordance with the equipment authorization procedures set forth in Part 2, subpart J, of the Commission's rules. Among other things, certification under Part 2 requires device testing to demonstrate compliance with the applicable specifications set forth in the Part 11 rules.

Although we intend to address these issues in our subsequent order, we note that, based on the record, it appears that some EAS Participants may have purchased such equipment. We remind EAS Participants that equipment that meets the definition of an encoder or a decoder under our rules must be certified under Section 11.34 of the Commission's current rules. In addition, equipment used to receive CAP-formatted EAS alerts must, at a minimum, comply with the CAP requirements the Commission adopted in the Second Report and Order. While we do not decide today whether intermediary devices comply with these requirements, it is unclear whether any equipment that does not meet these current baseline requirements will

- changes necessary? What are their potential costs and benefits? - we therefore defer these issues at this time. With respect to NAB's contention that the Part 11 rules should be clarified to make equipment manufacturers solely responsible for compliance with the ECIG Implementation Guide as part of the equipment certification process, we do not believe such action is necessary because manufacturers already are prohibited from marketing non-compliant equipment. Specifically, section 11.34 of the Commission's rules requires that the data submitted for certification of encoders and decoders ``show the capability of the equipment to meet the requirements of [Part 11].'' This data necessarily includes compliance with the ECIG Implementation Guide, conformance with which we are mandating in section 11.56. Further, section 2.803 generally prohibits the marketing of equipment subject to certification that
