With digital, the FCC no longer had to make a zero-sum choice. Spectrum was available for broadcast as well as other wireless uses. Thus, in 1992, the Commission allocated 220 MHz for "broadband PCS" in the 1.85- 2.20 GHz band.151 * The FCC also made additional spectrum available for wireless services by allowing broadcasters to choose between HDTV and multicasting, rather than mandating that broadcasters offer HDTV. Thus, in 1997, the FCC reallocated 108 MHZ of the 402 MHz that had been allocated for terrestrial television broadcasting, leaving 294 MHz for TV. Of the 108 MHz, 24

We also note that, while the December 2000 resale specials data for MR 5-01 shows a disparity of 8.56 percent, the disparity shown by a 4 month average of Verizon's data from September through December 2000 is only 1.85 percent, which is not competitively significant. We do not find, based solely on one month's performance measuring a low volume of orders, that Verizon fails to provide nondiscriminatory access to maintenance and repair OSS functions. In Louisiana, BellSouth missed the benchmark for UNE-P orders, on average, by only approximately 3% over the five-month period. See Louisiana B.1.4.3 (Reject Interval-Mechanized). Further, BellSouth states that it returned mechanically generated UNE-P rejects in an average of 1.85 to 4.36 hours from October to January in Georgia. See BellSouth March 22 Ex Parte Letter at Attach. A. We note that BellSouth also missed the benchmark for Other Non-Design in Georgia (53.57% to 76.06%) and Louisiana (66.67% to 91.67%). See Georgia B.1.4.15 (Reject Interval-Mechanized). BellSouth explains that the data improperly indicates poor performance for Other Non-Design because of instances

Based on the receiver noise temperatures submitted by the petitioners and the comments of XSI, it appears that the noise figure for the Sirius SDARS receiver is 1.85 dB, resulting in a receiver thermal noise floor of -112.8 dBm/MHz. Requiring the signal from the UWB device not to exceed the lower noise floor of -112.8 dBm/MHz and applying the 3 dB antenna cross polarization results in the same maximum separation distances that were specified in the R&O. Mr. Brewer's history of FCC-related transgressions and apparent contempt for the Commission's regulatory authority are patently inconsistent with his responsibilities as a licensee and belie any suggestion that he can be relied upon to comply with the Commission's rules and policies in the future. Consequently, pursuant to Section 1.85 of the Commission's rules, 47 C.F.R. 1.85, we hereby give notice of the suspension of Mr. Brewer's Amateur radio operator license for the remainder of its term and, pursuant to Section 312 of the Act, 47 U.S.C. 312, commence a hearing proceeding to determine whether Mr. Brewer's captioned Amateur radio station license and GMRS license should be revoked. Proponents 62 also argue that the specified aspect ratios are appropriate because 16:9 is already accepted worldwide, and 80% of motion pictures are shot at 1.85:1, which readily fits a 16:9 screen with negligible use of letterboxing.
