- Corp (CIEC) filed a petition for reconsideration (Petition) of a decision by the Wireless Telecommunications Bureau's Office of Operations (Office of Operations) awarding a request for a finder's preference to Daniel T. Meek (Meek).' The Office of Operations awarded a preference after Meek demonstrated that station WPBD3 39 was not constructed at its authorized location but at a location approximately 1.68 miles away. On January 5,2000, the Bureau's Commercial Wireless Division issued an order dismissing the Petition as untimely. For the reasons discussed herein, we find that the Petition was in fact timely filed,2 that the error in location was minor, and that station WPBD339 was constructed in substantial accordance with its authorization. Accordingly, the Order of January 5,2000 in this

- met under normal operating conditions." In the last section it is also noted "by some administrations that under current Radio Regulations, the class of station and the category of allocation of both and space stations need to be matched with each other. The paragraphs below are intended to address these issues. The first proposal is parallel to that in No. 1.68. In the second proposal the values for the band 5925-6425 MHz are taken from Recommendation ITU-R S.524, and the values for the band 14.0-14.5 GHz are taken from Recommendation ITU-R S.728. Reason: Adding this definition will ensure that the class of station and the category of allocation of both earth and space stations will be matched to each other. n

For the second year, the results indicate that WXYZ-TV attained a 0.05 percent share of total viewing hours (0.03 reported share + 0.02 standard error) and a 3.99 percent net weekly circulation share (2.33 reported share + 1.68 standard error). Accordingly, each of the reported audience statistics, plus one standard error, is below the criteria for a network station set forth in Section 76.5(i) of the rules (i.e., 3 percent share of total weekly viewing hours and a 25 percent net weekly circulation share). As a result, we find that the data demonstrates that WXYZ-TV is no longer
