- asserts that the Eckert Report is unresponsive to his requests. 5/3 AFR at 2, Attachment at 5-6. Id. Havens initially made these arguments in his FOIA requests Nos. 2007-177 and 2007-178. See notes 9 and 15, supra. 5/3 AFR at 2. See 5 U.S.C. § 552(a)(4)(A). The Commission's rules relating to FOIA processing fees are found at 47 C.F.R. §§ 0.466-70. 5 U.S.C. § 552(a)(4)(iii). See also 47 C.F.R. § 0.470(e). For example, a waiver cannot be justified on the basis of the requester's indigence or personal interest in the records requested, because to do so would be inconsistent with the public interest standard set forth in the statute. - schools, ``[a]s a practical matter, it is unlikely that a preschool or elementary or secondary school would be able to qualify for treatment as an `educational' institution, since few preschools, for example, could be said to conduct programs of scholarly research.'' We are unable to find that the requesting schools should be classified as ``educational institutions,'' as defined by section 0.466(a)(5) of the Commission's rules.[Footnote omitted.] No showing has been made here that the Archdiocese schools conduct programs of scholarly research, nor has the Archdiocese asserted that they do. Moreover, the OMB Fee Guidelines observe that ``[A]gencies should be sure that it is apparent from the nature of the request that it serves a scholarly research goal of the institution .

- On this basis alone, we find again that Skybridge does not meet the definition of a ``non-commercial scientific institution'' eligible for reduced fees. Separately and independently, Skybridge has again failed to show that it is ``not operated on a commercial basis'' for purposes of satisfying the second prong of the definition of ``noncommercial scientific institution.'' Under the definition in rule 0.466(a)(6), a ``non-commercial scientific institution'' must be an ``institution that is not operated on a commercial basis as that term is referenced in paragraph (a)(4).'' Paragraph (a)(4), in turn, describes a ``commercial use request'' as one ``from or on behalf of one who seeks information for a use or purpose that furthers the commercial interests of the requester. - by Fireside itself. It asserts that the requested documents have no ``direct relation to [Fireside], or to any commercial interest of [Fireside]...'' Because it currently holds no broadcast licenses and is therefore unable to generate any revenue, Fireside argues that it cannot have any ``commercial interest'' in the requested documents. We disagree. Fireside's argument is inconsistent with 47 C.F.R. § 0.466(a)(4), which defines a ``commercial use request'' as one ``from or on behalf of one who seeks information for a use or purpose that furthers the commercial interests of the requester.'' The succession of petitions and other pleadings filed by Fireside concerning FM Auction 37, the imposition of the bid withdrawal penalties on Fireside, and the impact of that action clearly

Section 0.461 refers to both calendar and business days, and will be corrected to consistently refer to calendar days. The words ``representation of the news media'' in the last sentence of Section 0.466(a)(4) will be changed to ``representative of the news media'' to reflect the original intent of the law. Section 0.467(a)(2) of our rules indicates that search and review fees for Commission employees are computed at the General Schedule level plus personnel benefits, but this does not include ``other non-FCC personnel who conduct a search'' as provided in Section 0.467(a)(1).
